Terms of Service

By creating an account, signing in, or otherwise using GameSpaces (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

GameSpaces lets you stream your own gaming PC remotely and/or rent cloud GPU instances to play games on. You are responsible for any games, mods, or content you install on a cloud instance and for complying with the applicable terms of those games and platforms. Please review our Privacy Policy for information on how we handle your data.

2. Eligibility

You must be at least 13 years old, or the age of digital consent in your country if higher, to create an account. By using the Service you represent that you meet this requirement.

3. Acceptable Use

You agree not to:

  • Reverse engineer, scrape, or interfere with the Service except as permitted by law.
  • Use the Service to host or distribute malware, spam, or content that violates third-party rights.
  • Mine cryptocurrency, run botnets, or consume resources beyond reasonable personal gaming use.
  • Attempt to gain unauthorised access to other accounts or our infrastructure.

4. Subscriptions & Billing

Paid plans are billed in advance via Stripe on a monthly or annual basis until cancelled. You may cancel at any time from Settings; cancellation takes effect at the end of the current billing period. Refunds are issued in accordance with applicable consumer protection laws.

5. Cloud GPU Sessions

Cloud sessions are subject to fair-use limits including resolution caps, AFK timeouts, and maximum session lengths based on your plan tier. We reserve the right to terminate sessions that exceed these limits or violate these Terms. Session availability may be affected by factors outside our control, including third-party infrastructure.

6. Intellectual Property

The Service, including its software, design, and trademarks, is owned by GameSpaces and licensed to you on a non-exclusive, non-transferable basis for personal use. Games and other third-party content remain the property of their respective owners.

7. Termination

We may suspend or terminate your account if you breach these Terms, if required by law, or to protect the integrity of the Service. Security concerns may be reported to [email protected]. You may close your account at any time. On termination, your data is handled in accordance with our Privacy Policy.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Streaming quality is dependent on your network conditions and hardware and is not guaranteed.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service is limited to the greater of the fees you paid us in the three months preceding the claim or $10 USD. We are not liable for any indirect, incidental, or consequential damages.

10. Changes

We may update these Terms at any time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by applicable law without regard to conflict-of-laws principles. Any disputes will be resolved in a court of competent jurisdiction.
